Riddle of the week answers:
1. Rambam says Keilim. Tachsheitin are worn / looked at, not used. That is different than a Keili that is used. Ramabam an end of Perek Aleph beis habichira
2. A. Mitzvas Asey shehazman grama. The wording is that everyone is Chayiv, but mitzvos asei to do during the day. Meaning it’s always a chiyiv but asei to only do during the day.
B. Usually mitzvos Asei shehazman grama if you miss it that time / day then you miss it. This is a constant mitzvah and can be fulfilled the next day as well.
C. Mitzva can be fulfilled with giving money, so the time constraint of the hazman grama is n/a.
3. Eidim not being able to be zomeim because of Rasha.
A. That’s circular reasoning. Any Eid as soon as they lie they did an aveira and should never have been allowed to testify.
B. There are exceptions where pasul relatives or multiple sets of witnesses can travel on shabbos even if their testimony will not be used.
C. At the time they testified there was nothing halachicly wrong with them being eidim.
D. Aveirah of chillul shabbos was not proven or befarhesya at the time, so at the time of testimony they were not Pasul.
An example that illustrates a few of these points. If you have someone who does online gambling from his phone in a discrete way and uses that as his main parnasa, that would be a pretty clear case of someone who is Pasul for eidus for gambling. But, until that’s proven beis din will accept his testimony. If he testifies falsely that someone owes someone else money, someone killed someone else, etc and has eidim come and say imanu hayisem to make him zomeim, can he then get off of kasher zamam, Malkos, etc by saying well i was really never fit for eidus and can now bring eidim that i was Pasul all along?
