The irreligious and Yayin Nesech: Clearing up common misconceptions

Why is wine touched by a non-Jew prohibited? Does this prohibition apply to a non-Jew who’s not an idol worshipper?
Is this extended to a nonreligious Jew who doesn’t keep Shabbos?
What is the status of someone who desecrates Shabbos but goes to shul or makes Kiddush?
What is the law of someone who’s embarrassed to desecrate Shabbos in front of a prominent person?
Do you need witnesses to testify in front of Beis Din to deem someone a Mechalel Shabbos?
Are you allowed to give non-religious Jews wine for them to drink?
Does touching a bottle of wine prohibit the wine?

Thanks for the show on yayin nesech, it’s nice to hear a show on the nitty gritty halachos just like you used to do when you first started the show.
I would like to point out that while you mentioned in EY a kula may occur when a hecsher may use a non mevushal wine and a non frum person is handling it, a similar or possibly worse kula happens in the US.
Since the agencies are all relying on R Moshe, they allow a goy to pour the wine in most establishments, which according to rov poskin in EY is 100% assur.
This should be taken into account that although we have R Moshes’ psak, perhaps it shouldn’t become a lechatchila to allow the goy to handle our wine, and rather it should be used bedieved and as a backup in case the goy handles it.
Thanks again

> Dear Dovid
> The answer to first riddle may be that the Din doraysa of bartzchem is only bZman shYovel noheg.

Do you have a מקור for this? Clearly the מגן אברהם ופרי מגדים disagree with this.

> The second riddle is from r Elchanon. I would like to add to his answer that Rashi in the beginning of chelek says that someone who believes in techias hameisim but he doesn’t believe that it’s from the Torah is an apikores.
> The third riddle I honestly do not know the answer to however I do not think that the way you spoke is considered respectful to the gedolei Yisroel and if you really want an answer there are better ways to go about it.

When you see a potential catastrophe occurring it’s not the time to start playing political niceties.

> I would also like to point out that many times in the past when the gedolim have paskened on your show not like the baal Igros Moshe you attacked them for arguing on the posek acharon of America. On the other hand there were many times that the gedolim have said like the great Igros Moshe and you brought on your show one or two people to say not like that and you attacked everyone else because ein lanu Ella Kohen shbyameinu. Just this past week you said over the Igros Moshe that yayin of a mumar lchalel Shabbos is asur and you took the liberty of arguing halacha lmaisa on the great posek acharon of America hagoen harav Moshe zatzal. It seems to me from this and many other similar things which I have heard over the past few years that you come on the table with an agenda to go against the gedolim of the yeshiva system in which you have been considered the top Bachur but unfortunately you
> turned your back on. When you find others from other circles such as modern orthodox to support your agenda against the bnei Torah and our gedolim you use them but if they chas vShalom agree with what the gedolim of mainstream yeshivos like the Mir say then you attack them also.
> This is the impression that I got, if you feel differently please clarify your position either by responding to this email or on the show or both. If you do not feel differently please take this a tochacha from a loving brother and change your ways. If I have spoken to strongly please forgive me for hurting you.

I pointed out this week that the Chsam Sofer, Aruch Liner, Chazon Ish,and others argue on Rav Moshe. They clearly have the standing to do so. Not sure what your point is.
